18 • VBA JOURNAL 18 • VBA JOURNAL VBA backs a slate of 2015 bills LEGISLATIVE AGENDA Use of Afdavits in Divorce Proceedings Te proposed legislation would clarify the statute regarding the use of afdavits in divorce proceedings. Te legislation would also adjust the residency requirements so that they are determined at the time of the fling of the lawsuit, rather than throughout pendency of the case. Use of Afdavits in Requests for Temporary Injunctions Te proposed legislation would make clear that requests for temporary injunctions may be supported or opposed by an afdavit or a verifed pleading. Te current statute references afdavits in its title but does not reference their use in the text of the Code section. Revised Uniform Limited Partnership Act Te proposed legislation would make a number of changes to Virginia's limited partnership statutes. First, the proposal would allow for a person to be a general partner without making a capital contribution or owning an ownership in- terest. Second, the proposal would change the dissolution requirements after withdrawal of a general partner to not require dissolution unless the limited partnership agreement provides otherwise. Revisions to Virginia Stock Corporation Act Te proposed legislation would make several changes to Vir- ginia's Stock Corporation Act to bring it in line with recent changes to the Model Act and the Delaware Code. Tese changes include modifcations to voting procedures, use of short-form mergers and qualifcations of directors. SCC Clerk's Ofce Legislation Te clerk of the State Corporation Commission is propos- ing legislation to update Virginia's statutes on certifcates of fact, reserved names and Virginia's Stock and Non-Stock Corporation Acts. Te Business Law Section requested that the VBA support this legislation, and the Board of Gover- nors approved this request.
